The Texas Sex-Toy Mystery Deepens

 A lawyer friend of the magazine writes to assure me that "the Fifth Circuit struck down Texas's law prohibiting the sale of sex devices as unconstitutional under the substantive due process right announced in Lawrence v. Texas."

I regard this with major relief. I don't like the idea of any state with that many guns also suffering from severe sexual frustration.

But now what I want to know is, if that law was struck down, why can Texans still not purchase the Vibrating Touch and other similar products?

Legal scholars, lay it on me.

Something else to remember: No Texas-elected judge is going to speak out against this and rectify the problem because their opponent in the next election will use this against them in the next election. In California, hey, no problem; but in anal-retentive Texas, a big problem.

After the decision, the state had 90 days to seek review in the U.S. Supreme Court. That gave them until yesterday. No sign of a cert petition being filed.

So now--today, actually--is it safe to say that the product can be purchased legally in Texas.
